What Clients Say

An awesome lawyer!!!!!! Mr. Snell was very professional and informative. He helped me to understand all aspects of my case. I personally felt as if he ws giving me the same service he would give his family member, if they were in a similar situation. I would definitely use him again and or recommend his services to friend or family. Good old fashioned customer service. Thanks Mr Snell for all you have done.

Not your average lawyer. Jeff was exceptional at explaining my case to me and he kept me informed every step of the way. He offered counsel so I could make informed decisions and he actually cared about me, not just my case. I would recommend him to anyone who is in need of a personal injury lawyer.

How a Case Works

A case generally moves like this. Nobody can honestly promise a timeline at the start. It depends mostly on your medical treatment.

  1. A consultation by phone or videoTell Jeff what happened. If you cannot drive after a serious crash, that is not a problem.
  2. Signing upThe attorney-client relationship begins only when a written agreement is signed.
  3. TreatmentGetting the right care, and getting it documented.
  4. The insurers deal with the firmAll communication with insurance companies goes through the firm.
  5. Records and billsWhen treatment is finished, every medical record and bill is collected. A claim usually should not be valued before then.
  6. The demand and negotiationA settlement demand goes to the insurer, followed by negotiation.
  7. Suit and mediation, if neededIf the case does not settle, it goes to suit and often to mediation.
  8. Workers’ comp in parallelWhere it applies, the comp claim runs alongside, sequenced so neither claim undercuts the other.

Hurt in a crash while working? You may have two claims.

Anyone driving for work (a salesperson on the way to a sales call, for example) who is hit by another driver can have both a workers’ compensation claim and a personal injury claim against the driver at fault.

The two claims affect each other. Under Georgia law, if comp benefits were paid, the employer or its insurer can have a lien on the injury recovery, limited to what it actually paid, and only if you have been fully and completely compensated. That is why the claims are sequenced so neither undercuts the other.

How a work-related crash claim works

Paramedics helping an injured driver in a car after an accident
  1. Workers’ compensationThrough your employer’s workers’ comp insurer, with strict notice and filing deadlines.
  2. Personal injuryAgainst the at-fault driver and their insurer, under Georgia’s fault and time-limit rules.

Georgia Rules Worth Knowing After an Injury

Short versions of the Georgia statutes that most often decide what happens next. Each has exceptions, so treat this as general information, not advice on your case.

Tell your employer within 30 days

Notice of a work accident is due to the employer immediately or as soon as practicable, and no compensation is payable unless notice, oral or written, is given within 30 days of the accident. The section lists exceptions.

O.C.G.A. § 34-9-80 Workers’ comp claims

File the claim within one year

The right to compensation is barred unless a claim is filed with the State Board of Workers’ Compensation within one year after the injury. If the employer furnished treatment or paid weekly benefits, the limit runs from the last treatment (one year) or the last weekly payment (two years).

O.C.G.A. § 34-9-82 Workers’ comp claims

Employers with three or more employees

The workers’ compensation law does not cover an employer with fewer than three regular employees in the same business in Georgia, unless the employer and employees choose to be covered.

O.C.G.A. § 34-9-2(a)(2) Workers’ comp claims

Two years for most injury lawsuits

Except as otherwise provided by law, an action for injuries to the person must be brought within two years after the right of action accrues.

O.C.G.A. § 9-3-33 Personal injury claims

Shared fault reduces, and can bar, recovery

If you were partly at fault, your damages are reduced in proportion to your percentage of fault. If you are 50 percent or more responsible, you cannot recover damages.

O.C.G.A. § 51-12-33 Personal injury claims

More questions and answers

What is personal injury?

Personal injury refers to harm caused to an individual due to someone else's negligence. This can include physical injuries, emotional distress, or financial losses. If you believe you have a personal injury case, it's essential to consult with a qualified attorney.

How to file a claim?

To file a claim, gather all relevant documentation such as medical records and accident reports. Next, contact our law firm for a consultation. We will guide you through the process and ensure your rights are protected.

What is workers' compensation?

Workers' compensation is a form of insurance providing wage replacement and medical benefits to employees injured in the course of employment. It is designed to protect both employees and employers. If you've been injured at work, you may be entitled to these benefits.

What should I do?

If you're injured, seek medical attention immediately. Document the incident and gather any evidence you can. Then, reach out to our firm to discuss your situation and explore your legal options.

Do I need a lawyer?

While it's not mandatory to hire a lawyer, having legal representation can significantly enhance your chances of a successful outcome. A lawyer can navigate the complexities of the legal system and advocate for your rights. We recommend consulting with us to understand your best course of action.

How long will my case take?

It depends mostly on your medical treatment. A claim usually should not be valued until treatment has finished and the full cost of the injury is known. After that comes the settlement demand and negotiation. If the case does not settle, it goes to suit and often to mediation. Nobody can honestly promise a timeline at the start.

Do I have to come to the office?

No. Most consultations happen by phone or video. After a serious crash many people cannot drive, and that is not a problem.

Can one work crash lead to two claims?

Often, yes. If you were driving for work and another driver caused the crash, you may have a workers’ compensation claim and a personal injury claim against the at-fault driver.

What cases do you not take?

Federal workers’ compensation, because federal employees are covered by a separate federal system this firm does not handle. And claims where the person already has a lawyer on the same matter.

When does Snell Injury Law become my lawyer?

Only when a written agreement is signed. Contacting the firm does not by itself create an attorney-client relationship.
