Personal Injury Lawyer in Canton, GA

Canton is where I-575 commuters start their drive and where suburban roads give way to country ones. Both produce serious crashes. If you were hurt in one, call Jeff Snell.

I-575

For most of Cherokee County, I-575 is the only fast way to work. It carries commuters south to I-75 and Atlanta every morning, and much of it has fewer lanes than the traffic needs. When traffic slows suddenly — for a crash ahead, a merge, or simply rush-hour volume — rear-end chains follow. Crashes on I-575 near the merge with I-75 further south compound the problem.

Lane and construction updates on I-575 come from the Georgia Department of Transportation.

Riverstone Parkway and the Highway 20 corridor

Riverstone Parkway is Canton’s main shopping area, with the left turns, parking-lot exits and signal queues that come with it. Highway 20, crossing Canton east to west, links it to I-575 and carries both commercial and through traffic.

Where suburban meets rural

Outside the center of Canton, Cherokee County’s roads change character quickly: two-lane roads with higher speed limits, curves, limited shoulders and little lighting. Highway 140 and Marietta Highway carry traffic between growing subdivisions and the town.

Crashes on these roads are different from the stop-and-go collisions in town. They happen at speed — head-on crashes when a driver crosses the center line, run-off-road crashes on curves, and collisions with slow-moving vehicles. The injuries tend to be more serious, and emergency response takes longer. See catastrophic injuries and motorcycle accidents — these roads are popular with riders.

Cherokee County and the courts

Canton is the county seat, and Cherokee County’s courts sit at the Cherokee County Justice Center here. Cherokee is the Blue Ridge Judicial Circuit, and Jeff Snell is a member of the Blue Ridge Bar Association. Most injury claims settle without a trial; if one does not, where it is filed depends on where the at-fault party lives.

Serious injuries in the county are often treated at Northside Hospital Cherokee. Keep your discharge papers and make sure the follow-up care actually happens.

Work injuries

Cherokee County has a large construction workforce, which built the growth of the past two decades. It also has manufacturing, healthcare and service jobs. Construction injuries, falls from height, and equipment accidents are common workers’ compensation claims. Sometimes someone other than your employer caused the injury, such as a subcontractor or a driver who hit your work vehicle. Then a second claim may cover what comp does not, including pain and suffering.

The rules

Georgia is an at-fault state. Your recovery is reduced by any share of fault assigned to you, and barred at 50% (O.C.G.A. § 51-12-33). Most injury claims must be filed within two years (O.C.G.A. § 9-3-33). Work injuries must be reported within 30 days (O.C.G.A. § 34-9-80) and the claim generally filed within one year (O.C.G.A. § 34-9-82).

What to do now

Get treated and keep every appointment. Get the report number from the Canton Police Department, the Cherokee County Sheriff’s Office, or the Georgia State Patrol. Do not give a recorded statement to the other driver’s insurer.

Consultations happen by phone or video. You speak with Jeff Snell directly.

Common questions

Why do rear-end chains happen on I-575?

Much of it has fewer lanes than the traffic needs, so sudden slowdowns for crashes, merges or rush-hour volume cause chain collisions.

Are rural Cherokee County crashes more serious?

Often. Two-lane roads with higher speed limits, curves and little lighting produce head-on and run-off-road crashes, and emergency response takes longer.

Where are Cherokee County's courts?

At the Cherokee County Justice Center in Canton. Cherokee is the Blue Ridge Judicial Circuit.

I was hurt on a construction site in Cherokee County. What claims might I have?

A workers' comp claim. If a subcontractor or another driver caused the injury, there may be a second claim covering what comp does not, including pain and suffering.

Who writes crash reports around Canton?

The Canton Police Department, the Cherokee County Sheriff's Office or the Georgia State Patrol.
