Injured in an accident?

Back and Neck Injury Lawyer in Alpharetta, GA

Back and neck injuries are the most common injuries in car crashes and the ones insurers argue about most. The claim is built from one thing: a complete medical record.

The injuries

Soft-tissue injury — strained muscles and ligaments in the neck and back, the injury usually called whiplash. Painful, often slow to improve, and routinely dismissed by insurers as minor.

Disc injuries. The discs between the vertebrae can bulge or herniate, pressing on nearby nerves. In the neck, that can mean pain, numbness or weakness running into the shoulders, arms and hands. In the lower back, pain and numbness down the legs. A herniated disc at a specific level is common after a crash: C4–C5 or C5–C6 in the neck, L4–L5 or L5–S1 in the lower back. It usually only shows up properly on an MRI.

Fractures and spinal cord injury — the most serious end, from high-speed crashes, falls from height and pedestrian and motorcycle impacts. See our catastrophic injury cases.

MedlinePlus, from the National Library of Medicine, has a plain-language guide to herniated disks if you want to read more about the injury.

How treatment usually goes

The medical course of a back or neck injury tends to follow a recognizable order. Every step needs to be documented, because the claim is built from it:

  1. Emergency room or urgent care, often the day of the crash. X-rays there often come back normal, because they do not show soft tissue or discs.
  2. Chiropractic care or physical therapy — weeks of it, if the pain does not resolve.
  3. An MRI, usually ordered when symptoms persist — the scan that shows disc injuries.
  4. An orthopedist or spine surgeon to review the MRI and decide on next steps.
  5. Injections — epidural steroid injections or similar — if conservative care is not enough.
  6. Surgery in some cases, such as a discectomy or fusion.

A gap anywhere in that sequence, such as weeks with no treatment, is what an insurer will point to. It will call the gap proof the injury was not serious. Keep every appointment.

“It’s degenerative”

This is the most common argument in back and neck claims. Most adults over thirty show some age-related wear on a spine MRI. The insurer will say your disc problem was already there.

The answer is that Georgia law does not require you to have had a perfect spine. If the crash made an existing condition worse, that aggravation is part of the claim. No symptoms before and real symptoms after is the usual pattern. Proving it means showing the “before”: medical records, or the absence of them, and people who knew how you lived before the crash.

What these claims are worth depends on the treatment

There is no standard value for a herniated disc. The claim is built from the medical record. That means what treatment was needed, what it cost, how long it lasted, whether it worked, and what limits remain. That is why these cases should be valued at the end of treatment, not the beginning.

If you were working

Back injuries are the most common workplace injury there is, and they are just as common in crashes that happen on work drives. If either applies, there may be two claims: workers’ compensation through your employer, and a claim against whoever caused the crash. See work-related car accidents.

Generally you have two years from the injury to file suit (O.C.G.A. § 9-3-33).

Common questions

Why were my X-rays normal if my back still hurts?

X-rays show bone, not soft tissue or discs. Disc injuries usually only show up properly on an MRI, which is often ordered when symptoms persist.

The insurer says my disc problem is degenerative. Does that end my claim?

No. Most adults over thirty show some wear on a spine MRI. If the crash made an existing condition worse, that worsening is part of the claim under Georgia law.

What is a herniated disc?

It is when one of the discs between the vertebrae bulges or ruptures and presses on nearby nerves. In the neck it can cause pain or numbness into the arms, and in the lower back, down the legs.

Why do gaps in treatment matter so much?

Insurers point to weeks without treatment as proof the injury was not serious. Keeping every appointment protects the claim.

How much is a back or neck injury claim worth?

There is no standard value. The claim is built from the medical record: what treatment was needed, what it cost, how long it lasted and what limits remain. So it is valued at the end of treatment.
